PERSONAL DATA PROTECTION LAW (KVKK)

1. Identity of the Data Controller

As Kylo Makine Sanayi ve Ticaret A.Ş., acting as the data controller within the scope of the Personal Data Protection Law No. 6698 (“KVKK”), we attach great importance to the security of your personal data. This clarification text has been prepared to explain which of your personal data we process, for what purposes and based on what legal grounds, with whom we share your data, and your rights under the KVKK.

2. Processed Personal Data

As Kylo Makine Sanayi ve Ticaret A.Ş., we may process the following categories of personal data in order to provide our products and services, provide technical support, and fulfill our legal obligations: a) Identity Information:

  • TR Identity Number (in cases of legal obligation)

3. Purposes of Processing Personal Data

Your personal data is processed for the following purposes:

  • Fulfillment of legal and regulatory obligations (tax, invoice, etc.)
  • Information and promotional activities regarding our products and services (with explicit consent)

4. Legal Basis for Processing Personal Data

Your personal data is processed within the scope of Article 5 of the KVKK under the following legal grounds:
  • Necessity for the establishment or performance of a contract
  • Fulfillment of the legal obligations of the data controller
  • Necessity for the protection of our legitimate interests
  • Presence of explicit consent of the data subject (marketing communications, etc.)

5. Transfer of Personal Data

Your personal data may be transferred to the following parties within the scope of Articles 8 and 9 of the KVKK, provided that it is limited to the purposes stated above:
  • Authorized public institutions and organizations (in case of legal obligation)
  • Business partners from whom we receive accounting, financial advisory, and legal services
  • Logistics and cargo service providers
  • Suppliers providing information technology and software services
In the event of international data transfer, the transfer is carried out in cases where the guarantees within the scope of Article 9 of the KVKK are provided.

6. Retention Period of Personal Data

Your personal data is stored for the duration required by the purpose of processing and in accordance with the periods stipulated in the relevant legislation. Contract-based data is retained for 10 years following the termination of the contract; invoices and commercial documents are preserved for the legal periods in accordance with the provisions of the Turkish Commercial Code and the Tax Procedure Law. In the event that the retention period expires or the purpose of processing ceases to exist, your data is destroyed using secure methods.

7. Rights of the Data Subject

Within the scope of Article 11 of the KVKK, you have the following rights:
  • To learn whether your personal data is processed or not
  • To request information if your personal data has been processed
  • To learn the purpose of processing and whether it is used in accordance with its purpose
  • To know the third parties to whom it is transferred domestically or abroad
  • To request correction of incomplete or incorrectly processed data
  • To request its deletion or destruction within the framework of Article 7 of the KVKK
  • To request notification of the correction and deletion operations to the third parties to whom it has been transferred
  • To object to the occurrence of a result against you by analyzing the processed data exclusively through automated systems
  • To request compensation for the damages in case you suffer damage due to unlawful processing

8. Application to Exercise Your Rights

To exercise your rights stated above, you can apply in writing through the following channels: E-mail: info@kylo.com.tr Postal Address: Kylo Makine Sanayi ve Ticaret A.Ş, Istanbul, Türkiye Your application must clearly include your name, surname, signature (for written applications), TR Identity Number, and your request. Depending on its nature, your applications will be concluded free of charge within a maximum of 30 days in accordance with Article 13 of the KVKK.
